Digital Millennium Copyright Act (DMCA) Notice

Claims of Copyright Infringement & Related Issues (17 U.S.C. § 512 et seq.)

Pan Am Global Holdings LLC (“Pan Am,” “we,” “our,” or “us”) respects the intellectual-property rights of others and expects users of its websites, digital platforms, and affiliated online properties to do the same.

If you believe that your copyrighted work has been copied, posted, or distributed through any Pan Am-operated website or platform in a manner that constitutes copyright infringement, please submit a written notice to our designated Copyright Agent containing the information described below.

Upon receipt of a valid DMCA notice, Pan Am will act expeditiously to remove or disable access to the allegedly infringing material in accordance with applicable law.

A. Filing a Copyright Infringement Notice

Your written notification must include each of the following elements:

  1. Identification of the copyrighted work that you claim has been infringed, or, if multiple works on a single site are covered by one notice, a representative list of such works.
  2. Identification of the infringing material that you claim is infringing or the subject of infringing activity, together with information reasonably sufficient to permit Pan Am’s Copyright Agent to locate the material (e.g., the specific URL).
  3. Your contact information, including your full legal name, mailing address, telephone number, and, if available, an email address.
  4. A statement that you have a good-faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
  6. A physical or electronic signature of the person authorized to act on behalf of the copyright owner.

Please note: Under federal law, knowingly misrepresenting that material is infringing may subject you to substantial civil penalties, including damages and attorneys’ fees.

B. Counter-Notification (If You Believe Material Was Removed in Error)

If you believe that content you posted on a Pan Am platform was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to the Copyright Agent. A valid counter-notification must include:

  1. Your physical or electronic signature;
  2. Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before removal;
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, and telephone number, and a statement consenting to the jurisdiction of the federal district court for the judicial district in which your address is located—or, if outside the United States, for any judicial district in which Pan Am may be found—and that you will accept service of process from the original complainant or their agent.

Upon receipt of a valid counter-notification, Pan Am may restore the removed material in accordance with the DMCA unless the original complainant files an action seeking a court order to restrain the infringing activity.
